Terms of Service

By installing the application, you agree to these terms of service. The BallotBox application was developed and is protected under the international patent application for invention PCT / 2015 – 003253 “A method and Electronic Voting System implemented in a Portable Device”. More information can be found on www.ballotbox.dgo-on.com (in Chile the rights are under the registration number 55865 assigned on April 20, 2018 by INAPI).

DEFINITIONS

“Application” refers to the software provided by BallotBox to provide services related to BallotBox for use on Apple iOS devices and Android OS, from time to time in any updates and in any other software or documentation that enables the use of the application. “Terms of use” refers to the terms and conditions related to the use of the application and what is detailed in this document.

DATA PROTECTION

All personal information you provide when using the application will be used by BallotBox in accordance with the privacy policy.

PROPERTY RIGHTS AND LICENSE

Trademarks, copyrights, database rights and other intellectual properties of any kind of the application, together with the underlying software code, belong directly to BallotBox.

TERMS OF USE

You will not make or allow a third party on your behalf to make and distribute copies of the application, attempt to copy, reproduce, alter, modify, reverse engineer, disassemble, decompile, transfer, exchange or translate the application, or create derivative works of this application. The application is currently available at no charge for your personal and non-commercial use. BallotBox reserves the right to modify or withdraw the application, or the service provided pursuant to these terms of use, at any time and for any reason. You agree that the terms of the agreement with your respective mobile network provider (“mobile provider”) will remain in effect when using the application. As a result, the mobile provider may charge you for access to network connection services for the duration of the connection when accessing the application or for any third-party charges that may arise. You accept responsibility for any charges that may arise. If you are not the bill payer for the mobile phone or portable device you use to access the application, we will assume that you have received permission from the bill payer to use the application.

AVAILABILITY

This application is available for portable mobile devices with Apple’s iOS and Android OS operating systems. BallotBox will use all reasonable efforts to make the application permanently available. However, you agree that the application is provided over the Internet and mobile networks, and thus the quality and availability of the application may be affected by factors beyond the reasonable control of BallotBox. BallotBox, its group of companies and its subcontractors do not accept any responsibility for the lack of availability of the application, any difficulty or impossibility of downloading or accessing the content or any other failure in the communication system that may cause the lack of availability of the application. BallotBox will not be responsible for the maintenance and technical service of the application.

SYSTEM REQUIREMENTS

To use the application, you will need to have a compatible mobile phone or portable device, Internet access, and minimum requirements (“software requirements”). The software requirements are as follows: Apple iOS devices, such as the iPhone or iPod Touch, running iOS 10.0 or higher, and with an active data connection: Android devices, such as the Samsung Galaxy S9, running Android 8 or higher, and with an active data connection. The application software version will be updated from time to time to add support for new features and services.

RESCISSION

BallotBox may terminate the use of the application at any time. At the time of termination, the rights and licenses granted herein will terminate.

LIMITATION OF LIABILITY

Under no circumstances will BallotBox be liable for direct, indirect, special, punitive, exemplary or resulting loss or damage of any kind arising from the use or access to the application, including lost profits or similar damage, whether or not contemplated by the parties. , whether based on breach of contract, civil wrongdoing (including negligence), product liability or any other circumstance. BallotBox is not responsible for any damage or modification to your equipment, including but not limited to portable device or mobile phones, as a result of the installation or use of the application. No information in these terms of use shall exclude or limit BallotBox’s liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
